On March 1, 2017, the New York State Department of Financial Services’ (DFS) mandatory cybersecurity requirements for financial services entities became effective, with implementation to occur within 180 days (August 28, 2017). However, this regulation provides a limited exemption from some of those requirements for entities meeting certain criteria, and you need to file for this exemption by August 28, 2017.

How to File an Exemption
The Department of Financial Services (DFS) made available an online process for filing for the limited exemption through a secure portal.
Step 1: Visit http://www.dfs.ny.gov/about/cybersecurity.htm .
Or easily look for and click the this image on the home page for the DFS (www.dfs.ny.gov).
Step 2: You will need to create an account and a temporary password will be sent to you. (After you gain access, immediately you will need to create your own password).
Step 3: Click on "Submit Cybersecurity Notice of Exemption" and complete the information to complete the filing process. (You will receive an email confirmation from the DFS; please keep this as a record that you filed for an exemption).
Step 4: Learn what your exemption means and what DFS Cybersecurity Regulations are still applicable to your exempt organization here.
And remember, the limited exemption only needs to be filed one time. In the future, if your organization no longer qualifies for the limited exemption as of your most recent fiscal year you would then have 180 days to comply with all applicable requirements of the regulation.
